Our estate planning attorneys provide counseling and assistance regarding the preferred choice of entity, and to formulate plans that ensure an orderly transfer of business and personal assets with minimum transfer tax liability. Care is taken to coordinate the desired disposition of assets, including retirement plans, IRAs, annuities and life insurance, with minimum transfer tax and income tax liability, and with a view towards minimizing the potential for Will contests or other litigation. Finally, our estate planning attorneys are prepared to assist our clients with pre-marital agreements and often advise regarding marital property characterization issues.

TRUST, ESTATE AND FIDUCIARY LITIGATION

HSFB's Trust, Estate, and Fiduciary Litigation Practice Group attorneys represent individuals and corporate fiduciaries in disputes involving the construction and administration of trusts and wills, the modification of trusts, and the administration and settlement of estates. We have experience in handling complex will and trust contests and disputes, breach of fiduciary duty disputes, and other disputes arising from probate and inheritance rights. We are also experienced in handling guardianships, civil commitments and issues involving incapacity; requests for accountings and disputes over the exercise of powers of attorney; and common law marriage and related tax issues.

Mr. Hornberger is a shareholder in the firm. He was formerly a shareholder in the trust and estate section of the San Antonio law firm of Cox & Smith until 1992.

Details of Practice
Mr. Hornberger's practice is devoted primarily to trust and estate planning and trust and estate litigation in Bexar County's two statutory probate courts. Mr. Hornberger's trust and estate planning practice involves drafting of wills and trusts, estate, generation skipping and gift tax planning, asset protection, business planning and choice of entity. Mr. Hornberger's practice in Bexar County's two statutory probate courts involves both contested and uncontested trust and estate matters, including Will and Trust contests, actions to construe and modify wills and trusts, and other disputes arising in the administration of trusts and estates.

Professional Activities
Mr. Hornberger is Board Certified in Taxation and Estate Planning and Probate Law, and has served as President of the San Antonio Estate Planners Counsel. He is a member of the American Academy of Trust and Estate Counsel, as well as the International Academy of Estate and Trust Law. Mr. Hornberger is a Certified Public Accountant, and a member of the Texas Society and American Society of CPAs. He has served as member of the counsel of the Real Estate, Trust and Probate Law Section of the State Bar of Texas. He is a Fellow of the Texas Bar Foundation, and a member of the San Antonio, Texas, and American Bar Associations. He has been listed as a Texas Super Lawyer (Texas Monthly Magazine). Military Service: 1st Lt. (Infantry), US Army, 1981-1983.
